These Terms & Conditions apply to SkkyLight Web Services.

Minimum Term / "Contract"

In order to offer low pricing packages, SkkyLight does require a minimum term for the use of some services. In order to fulfill this minimum term, clients must provide payment for services until the end of the period. The period ends at the end of the last billing cycle of the term. Once minimum terms are fulfilled, no additional minimums are required unless agreed upon by SkkyLight and the client for additional services rendered. Due to the nature of our billing, SkkyLight does not offer an early termination fee. To terminate service, the remainder of the term must be paid in full.

Cancellation

Cancellation of an account may be requested at any time on our cancellation page in the Support Center. Please see the Minimum Term / "Contract section before requesting cancelation. See also Web Design Content and Domain Registration in this document.

Unlimited Changes for First 30 Days

SkkyLight does offer unlimited changes for the first 30 days of service. While the term “unlimited” is used, this does only apply to reasonable changes. The purpose of the term "Unlimited" is to indicate that numerous changes will be necessary during the setup process and additional fees will not be required for these changes. Typically, a general design is created and approved by the client. After this, photos, text, and other items are added to the site until complete.

Based on client requests, SkkyLight will determine what requests are reasonable and those that are not reasonable. Any requests that negatively impact or intentionally overwhelm SkkyLight services will not be considered reasonable.

Basic & Premium Changes

All of our design and e-commerce solutions offer continuous updates to your website and shopping cart. Each month, based on the package you choose, you are allotted a certain number of Basic or Premium Changes (defined at the end of this section). Three Basic Changes are equal to one Premium Change.

Basic Changes may be used at any time during a calendar month from the first day to the last day. Basic Changes do not carryover from one month to another. Basic Changes that are not used at the end of a month, may only be applied for use toward a Premium Change for that quarter.

Premium Changes are equal to three Basic Changes. In order to use a Premium Change, three Basic Changes will be deducted from the monthly allotments for that quarter. If there are not enough Basic Changes to fulfill the Premium Change, additional Basic Changes may be purchased at the standard rate. Basic Changes will be deducted from the allotment begining with the earliest month in the quarter.

EXAMPLE 1: A client receives two Basic Changes per month and would like to make a Premium Change in February. The client did not use any Basic Changes in January. Two Basic Changes will be deducted from those not used in January and one Basic Change will be deducted from February.

EXAMPLE 2: A client receive two Basic Changes per month and would like to make a Premium Change in February. The client used all Basic Changes in January and February. The client only has two Basic Changes available for the quarter from March. The Basic Changes from March would be used and an additional Basic Change would be purchased at the standard rate to fulfill the Premium Change. Any further Basic Changes needed in February or March would require purchase of additional Basic Changes at the standard rate.

Changes that are required due to typos or other errors on the part of SkkyLight are free. Changes required due to typos or other errors on the part of the client will be deducted from the monthly changes allotment or (if allotment has been used) be billed at the standard Additional Changes rates. SkkyLight will make the final decision in determining who is responsible for any errors.

Billing or Package Changes

Note: Credits are not required for the first 30 days of services. During that period, unlimited changes (see Unlimited Changes First 30 Days) are allowed to get the site up and running to the client’s specifications.

Text Changes. A text change is defined as changing any amount of text on a single page. Text content must be supplied to SkkyLight in order to make this change. Multiple changes on one page are equivalent to only one overall change.

Photo Changes (or graphic). A Photo Change is defined as a changing any single image. Changing two images on one page is equivalent to two Photo Changes. Changing two photos on separate pages is equivalent to two changes.

Domain Registration

New domains are registered through a third party registrar in the name of SkkyLight. SkkyLight provides this as part of all monthly (or other billing period) services and the domain names are leased to clients through this service. In the event of termination of an account, domain names are the property of SkkyLight. Clients wanting to continue to use domains registered through SkkyLight may purchase the name for a fee to be determined by SkkyLight.

Clients terminating SkkyLight Web Design Packages may continue to use domain names by converting their accounts to a SkkyLight Web Hosting Package. Standard rates will apply.

Transferred domains (those owned by clients prior to transferring to SkkyLight) remain the property of the client. In the event that SkkyLight Web Design Packages are terminated, clients may convert their account to a SkkyLight Web Hosting Package, continue to renew their domain through SkkyLight for the standard rate, or request a release of the domain name. Once SkkyLight services are terminated, the client will be responsible for all fees and requirements necessary to maintain the domain name.

Web Design Content

All content designed by SkkyLight is copyrighted and is the property of SkkyLight. The design, layout, text, or any other aspect of a site created or modified for use is protected by this copyright. Protected content cannot be copied, duplicated, or recreated without violation of copyright law. Designs are not to be copied from SkkyLight hosted servers to another server without the written permission of SkkyLight. In the event that an account is terminated, all aspects of your site remain the property of SkkyLight and may not be copied or modified in any way or through any means without the written permission of SkkyLight. In this event, you may request a quote for the purchase of SkkyLight files for a one time fee. SkkyLight reserves the right to deny any request for copyrighted content. SkkyLight also reserves the right to delete any content at any time after account termination.

Content (images, text, PDFs, Word documents, Excel documents, etc) provided to SkkyLight by you or third parties may be copyrighted, but are not the property of SkkyLight. You may copy or request removal of this content from the site at any time. Standard rates do apply. Upon termination of the account, you may request for this content to be deleted. In the event that SkkyLight deletes the design content, any provided content will also be deleted and may not be able to be retrieved. Please keep your own copies of all provided content.
